Jenkins Lawsuit Against Sustainable Playland Inc. Is Delayed

Legislator Ken Jenkins wants the County's contract with SPI invalidated.

A lawsuit filed last year by Legislator Ken Jenkins (D-Yonkers) to block the contract between the county and Sustainable Playland Inc. has been postponed to July 11, according to Jenkins.

The case was scheduled to be heard on June 19. Jenkins sued after County Executive Rob Astorino signed the 10-year agreement with SPI, but recently Astorino proposed a change to SPI's role and said the group would now concentrate on fundraising.

Additionally, the lawsuit has had nearly as many ups and downs as Playland's famous Dragon Coaster.

The press release from Jenkins is below:

Westchester County Legislator Ken Jenkins' (D-Yonkers) lawsuit seeking to invalidate the contract with Sustainable Playland (SPI) signed by County Executive Rob Astorino has been moved to July 11th from June 19th.

Evan Inlaw, attorney for Legislator Ken Jenkins said the legal action will move forward. "The contract with SPI has not been terminated. County Attorney Robert Meehan has filed a motion with the court that has caused this change in date."

Said Jenkins, "the contract needs to be invalidated and the BOL must approve any contract regarding Playland."
