Rye Insurance Claim: Just Buying Time?

If there is an actionable meritorious claim for municipal insurance recovery in the Rye Golf Club – RM Staffing & Stealing thefts then believe me I’m 100% in favor of it. And I’m glad we have new Councilmen McCartney & Slack on the case because it’s been a year since RYE CITIZENS (not Rye officials or any ‘law enforcement’ agency) broke this tawdry tale of theft, lies and municipal deceit.

Rye Corporation Counsel Wilson, Mr. Plunkett’s Rye protégée, claimed she first submitted this insurance claim a full year ago and since then nothing has been said about it except - “we’re working on it.”

Meanwhile the Rye City Review reports that Mr. Scott Yandrasevich (photo above & charged criminally with stealing serious dollars over a serious amount of time from club members) is not only free to walk the streets but has been offered multiple chances by the White Plains DA to prevent a public trial. Why would the DA want to do this?

The White Plains DA didn’t uncover this crime. Senior managers in Rye didn’t uncover this crime. Rye senior managers instead blocked lawful public information requests left and right, obstructing the investigation until they could no longer hold out to public outcry. Those Rye senior managers were aided in their attempts to discredit the issues here by Rye elected officials – most notably former Mayor French – and his Deputy Mayor Jovanovich.

Just Buying Time (JBT) is a recognizable legal strategy to avoid accountability and exposure of wrongdoing while working secretly on alternative escape routes. Here the attempted “escapee’s” might include a group of Rye City fiduciaries who almost certainly enabled Mr. Yandrasevich’s capers.

To see JBT in action one might watch former IRS official Lois Lerner’s upcoming performance this Wednesday in Washington where she is now expected to give not a smidgen of addition targeting evidence under oath. Or you could alternatively Google “Watergate.”

JBT was employed locally to string out the Schubert’s Pond wetland violation matter until Schubert himself was 6 feet under. And JBT is apparently is underway here again with the Golf Club insurance claim – a claim that even very experienced attorneys might be hard pressed to defend claims for coverage under.

This morning a copy of a denied Rye City taxpayer FOIL request related to the status of the Rye Golf insurance claim reached my inbox. Transparency was I thought a promise that the new administration was very serious about. Old dodges die hard in Rye. And that’s a shame.
