Feds Won't Seek Death Penalty In Rye Town Hilton Murder

Update charges being sought in slaying at Rye Town Hilton.

Federal prosecutors said in court in White Plains today that they will not seek the death penalty in connection with the slaying of millionaire Ben Novack Jr. at the Rye Town Hilton in Rye Brook.

Novack's wife and her brother are charged with his murder at the hotel in July 2009 and with orchestrating the murder of Novack's mother, Bernice Novack, in Ft. Lauderdale, FL, in April 2009.

Authorities charge that Narcisa "Narcy" Novack of Ft. Lauderdale plotted with her brother, Cristobal Veliz, to kill her husband during a convention that her husband's company, Novack Enterprises, organized for the marketing company Amway at the Rye Town Hilton.

Ben Novack Jr., the son of the founder of the famed Fountainbleu Hotel in Miami, was found dead in his hotel suite after being bound, beaten stabbed.

Prosecutors said they are also seeking a new "superseding" indictment to update charges in the murder case. The current prosecution is based on federal indictments issued in April.
