Rye exploitation of undocumented labor, not simply fraud, heart of Rye Golf case.

Many in Rye now know about the tips and gratuities never paid to their waiters and waitresses at the city owned and managed Rye Golf Club. Many also now know about the sweat-house of a garage attic in Mamaroneck that underpaid and exploited undocumented foreign Rye Golf laborers were stuffed into over many sweltering summer months. And the horrendous amounts of overtime some were forced to work. For those unaware of any of this, a quick search of www.lausdeo10580.com will bring the testimony and documents about it to your fingertips.

Or you might read my own April 1, 2013 MyRye column bringing this exploitation matter to public attention – it’s here:

SCOTT YANDRASAVICH - SOLO CRIMINAL GENIUS?

Find out what's happening in Ryewith free, real-time updates from Patch.

What the many new faces on the Rye City Council bench may not know is that a pattern of violation of constitutional law and exploitation of undocumented foreign workers and religious organizations already links former the Rye City Corporation Counsel Kevin Plunkett (who “vetted” the Yandrasevich employment agency scheme according to current Rye City Manager Scott Pickup) with this kind of municipal lawbreaking, The latest being the Greenburg NY case just down the road where the insurance carrier has kicked in only a tiny fraction of the multimillion dollar amount now due the victims of this reckless and craven municipal malfeasance.

So for those here looking to catch up – here are some other local legal news stories about matters Mr. Plunkett “advised” (or ‘vetted?”) in the past decade:

Mamaroneck to pay $500,000, taking more hospitable approach to day laborers

Mamaroneck to pay $825,000 to local yacht club in settlement

Mamaroneck Mayor: “For $8 (million) to $10 million, you should be building pools and community centers and parks, not giving it to lawyers,"

$6.5 million Greenburg settlement believed nation’s largest for a land-use case involving intentional discrimination against a religious institution. $5.5 million of amount to be borne by taxpayers.

DECISION – http://www.jdsupra.com/legalnews/decision-fortress-bible-church-v-feiner-42288/

SANCTIONS - “The record is replete with evidence regarding Defendants' intentional destruction of evidence and disregard for discovery obligations.”…”In addition to destroying evidence and not placing the appropriate litigation hold on documents in the Town's possession, Defendants failed to produce certain evidence to Plaintiffs. Such was made clear at trial…”Defendants' blatant disregard for its discovery obligations under the Civil Rules of Procedure compels this Court to hereby sanction Defendants in the amount of $10,000 for their spoliation of evidence and failure to comply with their discovery obligations under the Civil Rules of Procedure.”

Mr. Plunkett’s prior deputy, Kristen Wilson, is currently Rye Corporation Council. I’ll provide Patch readers with her own “greatest hits” at a future date. But until then just please remember, NYS Assemblyman Steve Otis, Deputy County Executive Kevin Plunkett and former city manager O. Paul Shew were Rye’s most senior fiduciaries when RM Staffing was approved for takeoff. Now that the wreckage is being combed through by the Westchester DA, let’s not forget who originally certified it airworthy.
